Memo that it is desired that Sir Thos. Mainwaring would please look into Lord Audley's pedigree and Doomsday if he have both or either of them, whether it do not appear in both or either of them. that about the time of Ed. II the Lordship of Horton, Horton Hey, Endon, and Rushton James were given to Tuckett, Lord Audley and Rushton Spencer to Lord Fitzwarren, who was Lord Spencer thereabouts, for that it doth appear by a Latin deed without date that Richard Le Loverd granted the Lordship of Rushton James to Henry de Bradshawe his nephew, who granted the Lordship of Rushton to Wm. Bradshaw and suffered a recovery and from this Bradshaw the now James Rode Lord Meane of Rushton James claims from this Lord Mean and hathe ever paid chief rent unto the Lord of Horton, and he and the freeholders of Rushton James have ever appeared at the Lord of Horton's Court Leet. It would be known whether by Doomsday Book or the Lord Audley's pedigree make anything out what relation this Richard Loverd was to Lord Audley or what this Loverd claimed, etc.

The date of this memo is about 1671 and is connected with the suit of the Lords of Horton v. the freeholders of Rushton James and elsewhere.

So it appears that the defendants who were freeholders in Rushton James won the case and did not owe suit to the Lords of Horton.

This indenture made between Randulph the son of Roger Antiocesone of Ruschton on the one part and Roger Mayot of the same vill on the other part, witnesses that: whereas the said Roger is bound in £5 by his bond to pay to the said Randulph on a certain day as by the said bond more plainly appears, the aforesaid Randulph wills and grants for him and his heirs and assigns that if neither he nor his wife nor his heirs be charged with 2½d annual rent issuing from a piece of land lying between the Urlesweye and the Wodehousfeld to the said Roger and Alice his wife and their heirs, then the said bond for £5 shall lose its force however the said Roger wills and grants for him and his heirs, that if the aforesaid Randulph or his heirs be charged with the aforesaid 2½d or in part therefore by him or by Alice his wife or their heirs or anyone else in their name, then the said bond shall stand in all its force and intent. In witness of which the aforesaid parties have alternatively set their seals to these letters of indenture.
